Hereinafter referred to as “HALIOTIS”.
2. Purpose and Scope
These Terms & Conditions govern:
· access to and use of the website;
· the online purchase of physical goods, services, vouchers and digital content;
· the rights and obligations between the customer and HALIOTIS.
By placing an order, the customer confirms that they have read, understood and accepted these Terms & Conditions.
3. Amendments
HALIOTIS reserves the right to update these Terms & Conditions at any time.
Changes apply only to orders placed after publication on the website.
4. Products and Availability
HALIOTIS offers physical goods, services, vouchers and digital content.
Product availability depends on existing stock. If a product becomes unavailable after an order is placed, the customer will be informed and fully refunded.
Product images are for illustrative purposes only.
5. Prices, Taxes and Manifest Errors
All prices are displayed in euros (€) and include VAT at the applicable legal rate, unless otherwise stated.
Shipping costs are displayed before order confirmation.
Manifest Pricing Errors
In the event of an obvious and manifest pricing error (for example, a clearly unrealistic or disproportionate price), HALIOTIS reserves the right to cancel the order, even after automatic confirmation, informing the customer and issuing a full refund of any amounts paid.
6. Orders Outside the European Union
Orders shipped outside the European Union may be subject to customs duties, import taxes or local charges. These costs are the sole responsibility of the customer and are not included in the purchase price.
7. Order Process and Contract Formation
The contract is considered concluded only when HALIOTIS confirms shipment of the product or makes the service/digital content available.
An automatic order receipt confirmation does not constitute final acceptance.
8. Payment Methods
Customers may use the payment methods available on the website, including:
· Credit/Debit Card
· Multibanco
· MB Way
· Bank Transfer
· Other available methods
Cash or cheque payments are not accepted for online purchases.
9. Retention of Title
Products remain the property of HALIOTIS until full payment of all amounts due has been received.
10. Delivery and Maximum Legal Deadline
HALIOTIS delivers to Portugal, the European Union, and other countries where available.
Delivery times are estimates.
Under applicable EU consumer law, and unless otherwise agreed, goods will be delivered within a maximum of 30 days from the conclusion of the contract.
If delivery does not occur within this period, the customer may grant an additional reasonable deadline or terminate the contract in accordance with applicable law.
11. Products Damaged During Transport
Customers should inspect the package upon delivery.
If visible damage is detected, the customer should:
· note the damage on the carrier’s delivery document;
· notify HALIOTIS within 48 hours at shop@haliotis.pt, attaching photographs.
HALIOTIS will assess the situation and provide an appropriate solution (replacement, repair, or refund).
12. Transfer of Risk
The risk of loss or damage transfers to the customer when the goods are physically delivered to them or to a third party designated by them.
13. Right of Withdrawal
Consumers have the right to withdraw from the contract within 14 calendar days without giving any reason.
The withdrawal period begins:
· on the day the consumer receives the goods;
· or, in the case of multiple deliveries, on the day the last item is received.
To exercise the right of withdrawal, customers must contact: shop@haliotis.pt
Returned goods must be sent within 14 days of notification.
Return shipping costs are borne by the customer unless otherwise stated.
Refunds will be issued within 14 days after receipt of the returned goods or proof of return.
14. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to, among others:
· customized or made-to-order products;
· sealed goods opened after delivery for hygiene reasons;
· digital content once supply has begun with prior express consent and acknowledgment of loss of withdrawal right;
· services fully performed with prior express consent.
15. Vouchers and Gift Cards
Vouchers or gift cards issued by HALIOTIS:
· are valid for the period indicated at purchase;
· are non-refundable once used;
· cannot be exchanged for cash;
· may be subject to specific campaign conditions.
HALIOTIS is not responsible for lost or improperly used vouchers.
16. Digital Content
For digital content provided by download or online access:
· access is granted after payment confirmation;
· the customer is responsible for ensuring technical compatibility;
· unauthorized reproduction, sharing or distribution is strictly prohibited;
· by initiating download or access, the consumer may lose the right of withdrawal where legally applicable.
17. Legal Warranty and Conformity
Products sold by HALIOTIS benefit from the legal warranty applicable under consumer law.
Consumers in Portugal
A 3-year legal warranty applies under Portuguese Decree-Law no. 84/2021.
Consumers in Other EU Member States
The legal regime of the consumer’s country of residence applies, with a mandatory minimum warranty period of 2 years, which may be longer under national law.
Consumers Outside the EU
The mandatory consumer protection rules of the country of residence shall apply where legally required, without prejudice to the governing law of the contract.
In the event of lack of conformity, consumers may be entitled to repair, replacement, price reduction or contract termination under applicable law.
18. Limitation of Liability
HALIOTIS shall not be liable for:
· temporary technical interruptions;
· carrier delays;
· customs procedures;
· force majeure events.
Nothing in these Terms limits mandatory consumer rights.
19. Force Majeure
HALIOTIS shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including strikes, natural disasters, war, pandemics, transport disruptions or telecommunications failures.
20. Governing Law and Jurisdiction
These Terms & Conditions are governed by Portuguese law.
However, mandatory consumer protection rules of the consumer’s country of residence shall apply where legally required.
